Welcome to HeyPulse! These Terms of Service ("Terms") govern your access to and use of the websites, mobile messaging channels, applications, and dashboards operated by Berry Street Research Group LLC, the company that owns and operates the HeyPulse product ("HeyPulse," "we," "us," or "our"). HeyPulse is not a separate legal entity; it is a product of Berry Street Research Group LLC.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you are entering into this agreement for a company or other legal entity (such as an employer configuring a workspace roster), you represent that you have the authority to bind such entity to these Terms.
1. Description of Service
HeyPulse provides a text-based sentiment and retention surveying tool. Employers upload employee rosters, configure survey intervals, and review employee responses on their dashboard according to each workspace's named or anonymous response settings.
2. Employer Roster Requirements & Consent
As an employer utilizing the Services, you are responsible for maintaining the accuracy of your employee roster.
Important Compliance Requirement:You represent and warrant that you have obtained all necessary consents, authorizations, and permissions required by applicable federal, state, and local laws (including the Telephone Consumer Protection Act - TCPA) to upload your employees' mobile phone numbers and to authorize HeyPulse to dispatch survey check-ins to those numbers. You agree to indemnify and hold harmless HeyPulse from any claims resulting from your failure to secure valid employee consent.
3. Text Messaging Program Terms ("HeyPulse Workplace Check-Ins")
Program description:HeyPulse Workplace Check-Ins is a recurring, automated messaging program owned and operated by Berry Street Research Group LLC. It delivers brief workplace sentiment check-in questions (for example, "How did your shift go?") to employees over SMS text messaging and email. Employers configure their roster, schedule, and workplace topics in the HeyPulse dashboard, but Berry Street Research Group LLC is the registered sender and legal operator of the messaging program. The program contains no marketing, advertising, or third-party promotional content.
- Opt-in Process: Employees are enrolled only after providing consent to receive recurring automated workplace check-in text messages from HeyPulse by Berry Street Research Group LLC. Employers may collect consent through onboarding paperwork, an employee handbook acknowledgment, a signed internal communications consent form, or an HRIS/workforce-management workflow that clearly names HeyPulse workplace check-ins and Berry Street Research Group LLC as the sender. The employer certifies, at the time of each roster upload or phone-number addition, that this consent was collected before any number is enrolled. Participation is voluntary, is not a condition of employment, and survey responses are never used punitively.
- Message Content:Messages identify HeyPulse and Berry Street Research Group LLC and ask brief workplace feedback questions, such as "HeyPulse by Berry Street Research Group LLC Check-In: Did you feel supported by your shift lead today? Reply with Yes / No. Reply HELP for help, STOP to opt out."
- Opt-out / Cancellation: You can cancel the SMS service at any time. Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. We will send one final SMS confirming that you have been unsubscribed, and your number is added to our suppression list immediately — no further messages will be sent unless you re-subscribe by replying START.
- Re-opt-in: Reply START or UNSTOP at any time to resume receiving check-ins.
- Help / Assistance: Reply HELP or INFO to any message, or email support@tryheypulse.com.
- Message Frequency: Message frequency varies based on the schedule configured by your employer in HeyPulse; typically 1 to 3 check-ins per week. The program is recurring until you opt out or your employer removes you from the roster.
- Message & Data Rates: Message and data rates may apply to all incoming and outgoing messages, according to your mobile carrier plan.
- No Third-Party Sharing: Mobile phone numbers and opt-in consent collected for this program will not be shared with, sold, or rented to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
- Carrier Limitations:Delivery of text messages is subject to the performance of your mobile carrier. Neither HeyPulse nor the mobile carriers (including T-Mobile, AT&T, and Verizon) are liable for delayed or undelivered messages.
- Email Delivery: Where text messaging is unavailable, paused, or you have opted out of texts, check-ins configured by your employer may instead be delivered to your work email address with the same one-tap response options.
4. Billing, Subscriptions, and Cancellation
- Paid Plans: Certain dashboard features and employee roster limits require a paid subscription. Billing is managed on a recurring monthly basis.
- Payment and Renewals: Your subscription will automatically renew at the end of each billing cycle unless you cancel or downgrade your plan.
- Cancellation: You can cancel your subscription at any time through your dashboard settings. Refunds are not provided for partial billing cycles.
5. Prohibited Use
You agree not to use the Services to:
- Upload phone numbers without authorization or send spam messaging.
- Transmit any harassing, defamatory, abusive, or unlawful content.
- Impersonate any person or entity, or falsify your association with a company.
- Interfere with or disrupt the technical integrity of the automated messaging gateways.
6. Limitation of Liability
To the maximum extent permitted by law, in no event shall Berry Street Research Group LLC or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use or inability to use the Services; (b) any unauthorized access to our servers or stored data; or (c) any delivery failures or delays of SMS text messages due to carrier operations.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action arising out of these Terms shall be filed in the state or federal courts located in New York, New York.
